Province Considering Further Extension of Virtual Meeting Provisions

As mentioned in our Blog from October 18, 2021, the temporary measures were most recently extended to September 30, 2022 (a date which is fast approaching!). For that reason, many condominium corporations have either passed, or are considering, their own by-laws to allow for virtual meetings and related matters.

However, the Province has said that a further extension of the enabling legislation may be coming.

Here’s the Province’s notice, which was issued yesterday (August 18, 2022):

As you may know, the temporary suspension period for certain temporary legislative provisions permitting corporations governed under the Business Corporations Act (OBCA), Corporations Act (CA), Not-for-Profit Corporations Act, 2010 (ONCA), Co-operative Corporations Act (CCA) and Condominium Act, 1998 (Condo Act) to call and hold meetings virtually, as applicable, notwithstanding certain restrictions or requirements in statute or a corporation’s governing documents, is currently set to expire on September 30, 2022.

We are aware that September 30 is quickly approaching and we are working on options to potentially extend the effective period of the temporary legislative provisions beyond September 30. We will provide an update when it becomes available and thank you for your patience.

This is good news for condominium corporations, because a further extension would continue the option to hold meetings virtually, without any need to pass an authorizing by-law.

That said, condominium corporations may still wish to consider passing a by-law (to authorize virtual meetings and related matters) – particularly if you have an upcoming meeting – because we don’t yet know for sure that an extension is coming from the Province, or how long the extension will be (if it does come).

As noted above, the Province will be providing an update; so we should have more detail soon!
